Thinking About Making a Claim Against a Company? Here's Where to Start

If you've had a dispute with a company, it can be difficult to know what steps to take next. Before considering legal action, there are several practical measures that may help resolve the matter more quickly and cost-effectively.

1. Try to resolve the issue directly. Contact the company and follow its formal complaints procedure. Clearly explain your concerns, provide any supporting evidence, and remain open to finding a mutually acceptable resolution.
2. Escalate the complaint if necessary. If you are unable to reach an agreement, find out whether the company has a head office, specialist complaints team, or is regulated by an ombudsman or industry body. These organisations may be able to review your complaint independently.
3. Consider Alternative Dispute Resolution (ADR). Alternative Dispute Resolution, such as mediation, can often resolve disputes without the need for court proceedings. Demonstrating that you have been willing to engage in ADR can also be viewed favourably if litigation later becomes necessary.
4. Check your insurance policy. Many household insurance policies include Legal Expenses Insurance, which may provide funding for legal advice or representation in certain disputes. It's worth checking your policy before instructing a solicitor.
5. Seek legal advice. If you have exhausted the available options and the dispute remains unresolved, it may be time to speak to a solicitor. Early legal advice can help you understand the strength of your claim, the options available to you, and the most effective way to move the matter forward.
