Why You Should Consider Making a Will and Putting a Lasting Power of Attorney in Place

Many people believe that making a Will or arranging a Lasting Power of Attorney (LPA) is something to think about later in life. The reality is that these are two of the most important legal documents you can put in place, regardless of your age.
A Will ensures that your wishes are carried out after your death. It gives you control over how your estate is distributed, who will administer your affairs, and, where applicable, who will care for your children. Without a Will, the law decides who inherits your estate, which may not reflect your intentions.
A Lasting Power of Attorney is equally important. An LPA is not about age, it's about planning for the unexpected. Life can change in an instant through illness, an accident, or other unforeseen circumstances, leaving you unable to make decisions for yourself.
There are two types of Lasting Power of Attorney:
Property and Financial Affairs LPA – allowing someone you trust to manage your finances, pay bills, and deal with your property if you are unable to do so.
Health and Welfare LPA – allowing someone you trust to make decisions about your care, medical treatment, and day-to-day wellbeing if you lose the capacity to make those decisions yourself.
While these conversations are not always easy, putting an LPA in place gives you peace of mind. It ensures that the people you trust can make decisions in accordance with your wishes, rather than leaving difficult decisions to the courts or people who may not know what you would have wanted.
Hopefully, your Lasting Power of Attorney will never need to be used. However, having one in place provides reassurance for both you and your loved ones, knowing that if the unexpected happens, the right people are legally able to support you.
